1. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you may only use our Services with the involvement of a parent or legal guardian.

2. Use of Services

You may use our Services solely for personal, non-commercial purposes. You agree not to:

• Use our Services for unlawful purposes.
• Attempt to interfere with, disrupt, or compromise the security of our Services.
• Copy, reproduce, or distribute our content without permission.

3. Prohibited Conduct

You agree not to, and will not assist or enable others to:

• Use the Services in any way that could damage, disable, overburden, or impair them.
• Access or attempt to access any part of the Services, Park Maxing systems, or third-party systems you are not expressly authorized to access.
• Probe, scan, or test for vulnerabilities (including by running automated scripts or security tools) without our prior written authorization.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise tamper with the Services, our code, or APIs.
• Circumvent, disable, or interfere with rate limits, usage quotas, security protections, or technical safeguards.
• Use automated scripts or scraping tools to extract data without permission.
• Abuse any free trial, demo, or promotional offering.

4. Security, Abuse & Enforcement

We take the security and integrity of the Services seriously. If we detect activity that we reasonably believe violates these Terms or threatens the availability or performance of the Services including but not limited to automated scraping, credential-stuffing, denial-of-service attempts, repeated unauthorized API calls, or other abusive behavior, we may, in our sole discretion and without notice:

• Throttle, rate-limit, or temporarily block access;
• Suspend or terminate accounts, sessions, or API keys;
• Restrict access from specific IP addresses or networks;
• Require additional verification (such as CAPTCHA or multi-factor checks) before restoring access; and/or
• Take legal action where appropriate.

Park Maxing Inc. may collect and retain technical logs (including IP addresses, request timestamps, and user-agent strings) as part of its abuse-prevention systems operated under FOMO Tech’s E.Y.E. - Evaluating Your Everymove™ Platform. These data are used solely to detect, investigate, and mitigate security incidents and will be handled in accordance with our Privacy Policy.

If you believe your access was suspended or blocked in error, contact us atprivacy@parkmaxing.com with details so we can review.

5. Remedies; Injunctive Relief

You acknowledge that any breach of the security or prohibited-conduct sections may cause Park Maxing irreparable harm for which monetary damages would be inadequate. In addition to other remedies available at law or in equity, Park Maxing Inc. shall be entitled to seek injunctive or equitable relief to prevent or stop such a breach without the necessity of posting bond.

6. Indemnification

You agree to indemnify, defend, and hold harmless Park Maxing Inc., FOMO Tech™, and their officers, directors, employees, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, misuse or abuse of the Services, or any prohibited or unlawful conduct.

7. FOMO Tech and E.Y.E.

Our technology and analytics wing operates under the brand FOMO Tech, a DBA of Park Maxing, Inc. Certain parts of the Services may run on FOMO Tech’s proprietary platform E.Y.E. - Evaluating Your Everymove™, which collects aggregated, anonymized usage metrics into a format that helps us improve site performance and product features. This data is anonymized and not linked to your personal information. Use of the Services constitutes consent to this processing as described in our Privacy Policy.

E.Y.E. does not record personally identifiable information; it analyzes behavioral signals (such as clicks and navigation) in the aggregate to refine the user experience and measure overall engagement.

8. Waitlist and Communications

When you join our waitlist, you provide your email address and optionally indicate whether you are a passholder. By signing up, you consent to receive emails from us about Park Maxing services, including updates on our mobile app and tools such as the Pass Maxing Calculator when launched.

You may unsubscribe from marketing emails at any time by following the instructions in the email.

9. Intellectual Property

All content, trademarks, logos, and designs appearing on our Services, including Park Maxing™, FOMO Tech™, Regret Prevention Engine™, E.Y.E. Evaluating Your Everymove™, and Pass Maxing™, are owned by or licensed to Park Maxing, Inc. You may not use, reproduce, or distribute our content without prior written permission, except for personal, non-commercial use.

10. Disclaimers

Our Services are provided for informational purposes only. We make no guarantees about the accuracy, completeness, or availability of our content. We do not represent or endorse, and are not affiliated with, Walt Disney World®, Universal Orlando®, or any other theme park operator. All park information is subject to change by those third parties.

Your use of our Services is at your own risk.

Analytics and optimization features are provided “as is” through FOMO Tech’s E.Y.E. - Evaluating Your Everymove™ Platform; they may evolve or be discontinued at any time.

11. Limitation of Liability

To the fullest extent permitted by law, Park Maxing, Inc. and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or reliance on our Services.

12. Social Media Data and APIs

If you follow or interact with Park Maxing™ or FOMO Tech™ on social-media platforms (such as X/Twitter, Instagram, YouTube, Facebook, or other social media platforms), those platforms may provide us with aggregated, anonymous analytics about audience size, engagement levels, and demographics through their built-in or public APIs. This data is anonymized and not linked to your personal information. We do not receive or request any personal profile data beyond what you choose to make public on those platforms.

This information is used solely to understand general trends such as how many users interact with our posts or visit our website after viewing content and to improve our marketing and communications strategy. Social-media data are subject to each platform’s own terms and privacy policies.

13. Third-Party Links

Our Services may contain links to third-party websites. We are not responsible for the content, policies, or practices of those websites. Accessing third-party websites is at your own risk.

14. Termination

We may suspend or terminate your access to our Services at any time, without notice, if we believe you have violated these Terms or engaged in misuse.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes will be resolved exclusively in the courts located in Osceola County, Florida.

We may update these Terms from time to time. When we do, we will update the "Effective Date" at the top of this page. Your continued use of the Services after changes are posted means you accept those changes.
